The webinar examines the challenges injured workers may encounter after settling their workers’ compensation claims. “Many organizations talk about advocacy for injured workers, but don’t understand the complexities that come with settlement,” Meyer said. “After having an adjuster, attorney or nurse case manager help them navigate the healthcare system, the injured worker is on their own to find and pay for medical care.”
When a Medicare Set-Aside is involved, the injured party needs to comply with CMS’s stringent rules, which include using funds only for treatment that is related the injury and that Medicare covers, paying according to the appropriate fee schedule, and meticulous annual reporting of how the funds were used. “Sometimes these obligations combined with the fear of exhausting their settlement funds prevent injured workers from settling,” he added.
The presentation also covers resources available to injured workers after they settle, including structured settlements, comprehensive professional administration services or administrative reporting tools, discounted medical networks and pharmacy discounts. “Insurance carriers and other payers can use these resources to help persuade an injured worker to settle a claim and to ensure that the injured party is taken care of long after the claim closes,” Meyer said.
