On May 15, 2020, the Centers for Medicare & Medicaid Services (CMS) released version 3.1 of the Workers’ Compensation Medicare Set Aside (WCMSA) Reference Guide (dated May 11, 2020). In sec. 1.1 of the new guide, it is indicated that:
Version 3.1 of this guide includes the following changes:

- The Life Table link has been updated (Section 10.3).
A side-by-side comparison confirms the only substantive change in v.3.1 version relates to an updated link to the 2017 Centers for Disease Control (CDC) Tables. This revised link can be found at sec. 10.3. As we had previously wrote, on March 23, 2020, CMS issued a notice that beginning on April 25, 2020, the CDC Life Tables for 2017 would be utilized for calculating life expectancy in WCMSAs. The 2017 Life Tables can be found here.
The only other change, found in Appendix 7, lists previous changes made in the prior version (v.3.0). As some may recall, v.3.0 of the WCMSA Reference Guide had significant changes as it related to professional administration. A link to our analysis on those changes can be found here.
